Terms of service

The agreement between you and BePostcodes when you subscribe. Short, because the service is simple.

1. Who this agreement is between

"We", "us" and "BePostcodes" mean Craig Simpson, a sole trader trading as BePostcodes.com, based in Moray, Scotland. "You" means the person or organisation that creates an account. By subscribing you agree to these terms and to our privacy policy.

2. What you get

A subscription gives you an API key and access to our WordPress plugins. Together they let visitors to your websites type a UK postcode and pick their address from a list. Every plan includes all of the plugins and can be used on as many websites as you like, as long as they are websites you own or manage.

Each plan includes a number of lookups a month. One lookup is one postcode search sent to us from one of your websites. Picking an address from the returned list does not use a lookup.

3. Plans, billing and prices

  • Plans are billed monthly or yearly in advance, in pounds sterling, through Stripe. Your subscription renews automatically at the end of each period until you cancel.
  • Your monthly lookup allowance resets at the start of each billing month. Unused lookups do not roll over.
  • If you use your allowance before the month ends, lookups stop until the allowance resets, you buy a top-up, or you move to a bigger plan. Top-up lookups never expire and are used only after the monthly allowance is spent.
  • You can change plan at any time from your dashboard. Stripe prorates the difference.
  • If a renewal payment fails we will email you and retry. If it still fails your API key stops working until payment is made.
  • We may change prices. We will give at least 30 days' notice by email, and a change only takes effect from your next renewal after that notice, so you can cancel first if you prefer.

4. Cancellation and refunds

You can cancel at any time from your dashboard. Your subscription stays active until the end of the period you have paid for, and is not renewed after that. We do not refund the unused part of a month or a year, and top-up purchases are not refundable. The same applies to monthly and yearly plans.

If you are a consumer rather than a business, you have a legal right to cancel within 14 days of subscribing. Because the service starts as soon as you pay, you agree that if you cancel within those 14 days we may charge for the lookups you have used.

5. Acceptable use

You may use the service to complete address fields on websites you own or manage. You must not:

  • share or publish your API key, or let anyone outside your organisation use it;
  • use the service to extract, copy or build a database of addresses, or to resell or redistribute address data;
  • make lookups by any means other than our plugins or an integration we have agreed to in writing;
  • use the service for anything unlawful, or in a way that interferes with the service for other customers.

Keep your API key secret. You are responsible for lookups made with it, including by your websites' visitors. If you think a key has been exposed, tell us and we will issue a new one.

6. The plugins

Our WordPress plugins are licensed under the GNU General Public License, version 2 or later, in line with WordPress itself. You may install, modify and redistribute the plugin code under that licence. The BePostcodes name and logo are not licensed and may not be used to suggest a plugin or service is ours when it is not.

The plugins only do anything useful with an active subscription and a valid API key. Access to lookups, plugin updates and support is part of the subscription, not the licence.

7. Support and availability

Support is by email, from the developer who wrote the plugins. We aim to reply within two working days. We do not promise a particular level of availability, but we use reasonable endeavours to keep the service running and will tell you about planned maintenance where we can.

The plugins are kept up to date with new releases of Gravity Forms, Contact Form 7 and WooCommerce. We may retire a plugin, with notice, if the software it integrates with is discontinued.

8. Address data

We return the addresses we hold for a postcode. We take care that they are complete and current, but we cannot guarantee that every address is present or correct, and you should let visitors edit or type an address if theirs is not listed. The plugins do this by default. You are responsible for how addresses are used once they are in your forms and orders.

9. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Otherwise, our total liability to you for anything arising from the service in any 12-month period is limited to the amount you paid us in that period. We are not liable for loss of profit, revenue, data or business, or for indirect or consequential loss, including losses caused by an address being wrong or a lookup being unavailable.

10. Ending the agreement

You can end it by cancelling your subscription and deleting your account. We can suspend or end your access if you break these terms, if a payment remains unpaid, or if we stop offering the service, in which case we will refund any unused part of a yearly subscription.

11. Changes to these terms

We may update these terms. We will change the date at the top and, for anything that affects what you pay or what you get, email you at least 30 days before it takes effect. Continuing to use the service after that means you accept the change.

12. Governing law

These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction over any dispute. If you are a consumer living elsewhere in the UK you may also bring a claim in your local courts.
